As part of the NStZ annual conference in Frankfurt am Main, Dr. Pragal had the opportunity to speak on the topic of “Conflicts of interest and risks of obstruction of justice in internal investigations” (see Pragal / Wolfgang Prinzenberg, Wistra 2023, p. 275 ff.).
Specifically, the topics covered were the purposes of investigations and the interests of companies; regulatory expectations of internal investigations in Germany / the impact of the VerSanG-E; a look at the USA; possible conflicts of interest during an investigation; possibilities for manipulating an internal investigation; the significance of the duty of truth under Section 43a (3) BRAO in the course of internal investigations; the relevance and transferability of the criminal defense attorney privilege; a detailed consideration of the risks of obstruction of justice and a general outlook for the future on the topic.
