Due to the increasing flood of regulations and the steady expansion of criminal law standards, preventive criminal law counsel in the form of qualified expert opinions is growing in importance for entrepreneurs, executives and private individuals.
After all: Ignorance does not always protect against punishment – however, a carefully crafted legal opinion may.
Under certain conditions, obtaining such an expert opinion has the advantage for the client that they can not only ensure the legality of their actions, but are also safe from punishment even if the prosecuting authorities’ assessment of the legal situation diverges from the expert opinion (so-called “unavoidable error of prohibition”, cf. § 17 S. 1 StGB).
