The topic goes back to an article published jointly by our two partners in Wistra (Pragal/Prinzenberg, Strafvereitelungsrisiken bei Internal Investigations, Wistra 2023, p. 275 ff., see also https://lnkd.in/ei2SwPt7).
Although the vast majority of investigations are conducted objectively and honestly, the rare “outliers” can have all the more dramatic consequences. The question arises as to when lawyers even run the risk of becoming liable to prosecution for obstruction of justice (Section 258 StGB) in the course of investigations. Setting clear boundaries could also help lawyers to defend themselves against (fortunately rare) attempts to influence them.
